2012 SINGLE FAMILY NONCOMPETITIVE PROGRAM FUNDS

A single family Montana home

Funds are reserved for use within each District by Entities approved to access funds for that District until 12/31/2012. On 1/1/2013, uncommitted 2012 funds will roll to District 1, the Statewide District, and any approved Qualified Entity with a MDOC contract can access the funds on a first come first serve basis until 6/30/2013. On 7/1/2013, any uncommitted 2012 funds will roll to the competitive pool of HOME funds.

  • All existing SFNP contracts for homebuyer assistance expired on March 31, 2011. Qualified entities must complete a new Single Family Noncompetitive Program Qualification Package and execute a new contract with the MT Dept of Commerce in order to continue to offer homebuyer assistance after 3/31/11

The Single Family Noncompetitive Program is an allocation of HOME funds for homebuyer assistance (HBA) and homeowner rehabilitation (HR) activities. Single Family Noncompetitive Program funds are distributed by formula among 4 districts of the state. Refer to the following announcement and program basics for additional information.

Qualification Package Eligible entities wishing to participate in the Noncompetitive Single Family Program for HBA and HR activities must submit a Qualification Package to the Program. Once the HOME Program approves an entity's qualification package, the entity may begin conducting its HBA or HR program within their service area.To become a "Qualified Entity", eligible applicants, incorporated cities and towns (except for the entitlement cities of Billings, Great Falls and Missoula) counties, or MDOC-certified CHDOs (except for activities within the city limits of Billings, Great Falls and Missoula must complete the qualification package and submit it to the HOME Program. DO NOT use the guidelines for a competitive grant.

SAFE Act Information

On January 6, 2010, the Housing Division held a Webinar for Nonprofit and For-Profit Entities and Local Governments Participating in Housing Division Homeownership Activities. New state and federal licensing requirements will affect how these entities do business if they participate in homeownership activities, including homebuyer assistance and homeowner rehab funded by the HOME program. The recent Montana Legislature enacted the Montana Mortgage Broker, Mortgage Lender, and Mortgage Loan Originator Licensing Act. In part this legislation was to implement the federal Secure and Fair Enforcement (SAFE) for Mortgage Licensing Act of 2008, intended to A home under a large tree

protect homebuyers from unfair lending practices. While the U.S. Department of Housing and Urban Development (HUD) has not yet issued the final rule for the SAFE Act, the essence of this law is to require any organization and its staff lending money for residential home mortgages to be licensed. ATTENTION ALL ENTITIES DOING HOMEOWNER REHAB ACTIVITIES: As of April 22, 2010 the U.S. Environmental Protection Agency's (EPA)  Renovation, Repair, and Painting (RRP) Program Rule applies to paid renovators, including renovation contractors, maintenance workers in multi-family housing, painters, and other specialty trades, who work in pre-1978 housing and child-occupied facilities. Under the rule, child-occupied facilities are defined as residential, public or commercial buildings where children under age six are present on a regular basis. CONTRACTORS ARE REQUIRED TO HAVE A CERTIFIED RENOVATOR ON BOARD FOR EACH JOB taking place in a home or facility defined by the rule.There are some differences between the EPA RRP Rule and the HUD Lead Safe Housing Rule (LSHR). A major difference is that the LSHR requires clearance examinations. All housing receiving federal assistance must still comply with the LSHR.
